1. Acceptance & Scope
These Terms of Use ("Terms") govern your access to and use of the website located at bebulbed.com (the "Site"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
These Terms apply only to the Site. They do not govern your use of any product or platform operated by a BeBulbed venture - including BeBulbed Spark, available at spark.bebulbed.com - which is a separate legal entity with its own Terms of Service, Privacy Policy, and Acceptable Use Policy. See Section 6 below.
2. Pre-Incorporation & Beta Notice
This Beta service is operated by BeBulbed (ABN 79 434 618 910) pending formal ASIC company registration. Upon ASIC registration, all contracts, user terms, intellectual property licenses, and data controller obligations will automatically assign to the newly registered proprietary limited company without requiring additional user notice or consent. References to "BeBulbed," "the Company," "we," "us," or "our" throughout these Terms refer to whichever of BeBulbed (ABN 79 434 618 910, pre-incorporation) or the newly registered proprietary limited company (post-incorporation) is the operator of the Site at the relevant time.
3. Who We Are
BeBulbed (ABN 79 434 618 910) is the parent holding brand for the BeBulbed family of independently operated ventures, currently registered as a business name pending formal incorporation as an Australian proprietary company (see Section 2). BeBulbed does not itself build, operate, or control any consumer product, and does not collect, process, or store user data on behalf of any venture. This Site exists to describe BeBulbed, its mission, and its family of ventures at a corporate level - it is not a product, and it does not offer accounts, subscriptions, or transactional functionality.
4. Permitted Use of the Site
The Site is provided for general informational purposes about BeBulbed and its family of ventures. You may view and share publicly available content on the Site for personal, non-commercial purposes. You agree not to:
- Misuse the Site, attempt to disrupt its normal operation, or interfere with its availability to others;
- Attempt to gain unauthorized access to any system, server, or data connected to the Site;
- Scrape, harvest, or systematically extract content from the Site using automated means without our prior written consent; or
- Use the Site in any way that violates applicable law.
5. Intellectual Property
All content on the Site, including the BeBulbed name, wordmark, logomark, and associated brand assets, is the property of BeBulbed (ABN 79 434 618 910), automatically assigning to the newly registered proprietary limited company upon ASIC registration as described in Section 2, unless otherwise noted, and may not be copied, reproduced, or used without prior written permission. Each BeBulbed venture (such as Spark) may hold its own distinct trademarks and brand assets, which are licensed from or by BeBulbed and are not made available for use through this Site.
6. Our Family of Products
The Site contains links to websites and products operated by BeBulbed ventures, including spark.bebulbed.com. These links are provided for your convenience. Each venture is a separate legal entity, solely responsible for its own product, content, data practices, and contractual terms. Following a link from this Site to a venture's product does not transfer, extend, or otherwise carry over any agreement, consent, or account relationship you have with BeBulbed. Once you leave this Site, that venture's own Terms of Service and Privacy Policy govern your use of its product.
7. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable law that cannot lawfully be excluded, restricted, or modified. To the extent these Terms are found to be an unfair contract term under the Australian Securities and Investments Commission Act 2001 (Cth) or the Australian Consumer Law, that term is void, and the remainder of these Terms continue to apply.
8. Disclaimer of Warranties
Subject to Section 7, the Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the Site will be uninterrupted, secure, or error-free.
9. Limitation of Liability
Subject to Section 7, and to the fullest extent permitted by law, BeBulbed and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your access to or use of the Site. This limitation applies solely to your use of this Site and does not extend to, or limit, the separate liability terms of any BeBulbed venture's own products, which are governed exclusively by that venture's own Terms of Service.
10. Governing Law & Disputes
These Terms are governed by the laws of South Australia and the Commonwealth of Australia. You and BeBulbed each submit to the non-exclusive jurisdiction of the courts of South Australia and the Federal Court of Australia in respect of any dispute arising out of or relating to these Terms or the Site. Nothing in these Terms requires you to arbitrate or litigate outside Australia, or limits any right you have to bring proceedings in an Australian court.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated "Last updated" date at the top of this page. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
